Description
Due Process Although appellee did not assert due process as a ground for its plea in bar, the reporter's record contains a
statement by the trial court, "I think from a due process standpoint, since that code section that was in effect at the time
said it shall state whether or not it involved, and judgment is silent, I think from a fundamental standpoint of fairness
it's a violation of due process to have to go in and basically potentially relitigate the issue of whether or not that offense
involved an act of family violence .
